J&K HC Judges' Appointment : One Proposal Recalled, One Deferred and One Sent Back By SC Collegium [Read Resolution]
Out of the three proposals for appointment as judges to Jammu and Kashmir High Court, the Supreme Court collegium has recalled one of them, deferred consideration of another and sent back the other to the High Court.
On August 24, 2017, the J&K HC collegium had recommended three advocates for elevation as HC judges : 1) Wasim Sadiq Nargal (2) Nazir Ahmad Beig, and (3) Showkat Ahmad Makroo.
Two names- Wasim Sadiq Nargal and Nazir Ahmad Baig- were finalised by the SC collegium on April 6, 2018 and were forwarded to the centre for approval. However, the centre referred the names back for reconsideration.
With respect to Wasim Sadiq Nargal, the collegium has sought more information from centre regarding the reasons for referral back and has deferred consideration of his name for the time being.
As regards the file of Nazir Ahmad Beig, the SC collegium has now decided to recall its recommendation by accepting the centre's objection."The Collegium therefore resolves to recommend that the proposal for his elevation need not be processed any further", said the minutes of the meeting held on January 16.
The proposal of Showkat Ahmad Makroo, which was not forwarded by the collegium to centre on April 6, has been now sent back to the HC by the SC collegium comprising CJI Ranjan Gogoi, Justices Sikri and Ramana.
