    The Karnataka High Court has ordered that in view of Section 2(e)(ii) of the Arbitration and Conciliation Act, a challenge to an award in an International Commercial Arbitration can be made before the High Court of Karnataka.

    As per a circular issued by the registrar (Judicial), a Commercial Division under Section 4(1) of the Commercial Courts Act, 2015 has been constituted, consisting of Single Judge at the Principal Bench at Bengaluru and Benches at Dharwad and Kalaburagi.

    Further, the circular says, "The proceedings filed Under Section 34 of the Arbitration and Conciliation Act, 1996, as regards the challenge to an International Commercial Arbitral Award before the Commercial Division shall be classified as COM.S."

    It is also said that all proceedings filed under Section 34 of the Arbitration and Conciliation Act, 1996 as regards the challenge to an International Commercial Arbitral Award which is classified as COM.S, all proceedings seeking for execution of an International Commercial Arbitral Award which is classified as AP.EFA and all proceedings seeking Interim Measures in respect of International Commercial Arbitration which is classified as AP.IM shall be posted before the Commercial Division.

    The circular says, "The Officers and officials working in the Filing Counter, Scrutiny Branches and Pending Branches of the Principal Bench at Bengaluru and Benches at Dharwad and Kalaburagi are hereby directed that henceforth all proceedings filed Under Section 34 of the Arbitration and Conciliation Act, 1996 as regards the challenge to an International Commercial Arbitral Award which is classified as COM.S, all proceedings seeking for execution of an International Commercial Arbitral Award which is classified as AP.EFA and all proceedings seeking Interim Measures in respect of International Commercial Arbitration which is classified as AP.IM shall be posted before the Commercial Division consisting of Single Judge at Principal Bench at Bengaluru and Benches at Dharwad and Kalaburagi."
