A Week After Sending Him To Jail, Karnataka High Court Orders Release Of Advocate In Contempt Case

The Karnataka High Court on Friday accepted the unconditional apology tendered by an advocate who was last week sent to judicial custody for contempt of court.
A division bench of Chief Justice Prasanna B Varale and Justice Ashok S Kinagi said: “ By accepting the apology, the contempt proceedings are closed. Respondent accused be released forthwith.”
On February 02, the court had said that it is left with no other option except to pass an order for taking advocate K S Anil into judicial custody for committing contempt of Court. It had directed that Anil be taken into judicial custody for a period of one week and produced before it on February 10.
Anil today filed an affidavit in which he submitted that he is a trial court junior advocate and suffers from various ailments. He also said he is poor in English and had no guidance from any senior advocate. He had submitted an apology through jail authorities on February 7.
The court had in its earlier order noted that the statement made by the accused making allegations against the judges clearly shows that the accused is having no regards to the judicial system.
"The accused being a practising advocate and consistent behaviour of the accused on the earlier occasions and today making wild allegations against the judicial system and the Judicial Officers in particular indicates that he is trying to demean the institution and is lowering the image of the judicial system in the public eye,” it had observed.
