Kerala Court Hears Rahul Mamkootathil For Bail In Third Rape Case, Arguments To Continue On Saturday

Principal District and Sessions Court, Pathanamthitta on Thursday (January 22) heard detailed arguments in the regular bail application of Palakkad MLA Rahul Mamkootathil in the third rape case alleged against him.
After hearing Mamkootathil's counsel and the prosecution for some time, Sessions Judge N. Harikumar posted the case on Saturday (January 24) for further hearing.
Mamkootathil has approached the Sessions Court after his plea before the Judicial First Magistrate Court, Thiruvalla was dismissed last week. He was arrested on January 11 following the registration of the present crime, the third case alleging the same offence.
The prosecution allegation is that Mamkootathil got acquainted with the victim through social media and that on April 8, 2024, he had induced her to book a hotel room where he committed rape on her. It is further alleged that the victim became pregnant as a result of the rape and she subsequently suffered a miscarriage. It is also alleged that Mamkootathil threatened her stating various things. He is accused of the offences under Sections 376 and 506(i) of the Indian Penal Code.
However, Mamkootathil has taken a plea that the relationship was consensual and that a false case was lodged against him due to his political standing.
In his bail plea before the Magistrate Court, the MLA has pointed out the inordinate delay in lodging the FIR. He had also taken a case that the victim had not signed the First Information Statement within 3 days as the same was an electronic document as mandated under Section 173 of the Bharatiya Nagarik Suraksha Sanhita.
Further, it was argued before the Magistrate that the mandatory medical examination of the victim had not been done. He also took the ground that the grounds of his arrest was not communicated to him.
The bail application is moved by Senior Advocate Sasthamangalam S. Ajithkumar, Advocates Sekhar G. Thampi and Abhilash Chandran.
