'Number of COVID Cases Are Increasing': Kerala HC Extends Interim Orders Until Further Orders [Read Order]

The Kerala High Court has extended all interim orders passed by it until further orders.

"The number of COVID cases are increasing. Situation has not changed in Kerala.", the Full Bench of the High Court comprising of the Chief Justice S. Manikumar, CT Ravikumar and Shaji P. Chaly observed in the interim order passed on 3rd August 2020.

The court has now posted the Suo Motu Writ Petition on 7th September 2020.

On June 30, the bench, in a suo motu case, had extended the subsistence of all the interim orders passed by it and the courts subordinate to it till 3rd August 2020. On Monday, the full bench took up the matter again to consider whether any modification is necessary. 

The bench has also directed the State and Central Governments to get instructions on the issue of initiation/continuation of recovery proceeding against defaulters by the bank. The court was considering an application filed by State Bank of India and Canara Bank who sought a clarification whether they can continue with SARFAESI proceedings which were already initiated. "Covid 19 pandemic situation continues and even at this point of time also, it cannot be said that the litigants are free so as to enable them to approach the Courts/Tribunals for vindicating their grievances against any coercive/recovery action, taken by the institutions", the bench said.
