Kerala High Court Grants Bail To 34-Year-Old Accused Of Attempting To Kill Another For Losing Carom Game

The Kerala High Court on Thursday granted bail to person accused of attempting to kill another for losing a carom game. Justice Viju Abraham in the order said:Considering the facts and circumstances of the case and taking into consideration the fact that petitioner is in custody from 05.10.2022 onwards and also the fact that the petitioner has no other criminal antecedents, I am inclined to grant bail to the petitioner. In the result, the bail application is allowed. The prosecution case was that on October 5, the accused wrongfully restrained the de facto complainant, and stabbed him on his right chest with an intention to kill him, due to his enmity towards the latter in losing a carom game. However, the de facto complainant was able to defend himself but sustained injuries on his right hand. The petitioner accused was accordingly, charged with offences under Sections 341, 324 and 308 read with Section 34 of the Indian Penal Code (IPC). Advocate V.A. Johnson, appearing on behalf of the petitioner accused, submitted that he had been falsely implicated in the said crime, and that he had no other criminal antecedents. It was further submitted that since he had been in custody since the alleged date of occurrence of the incident, his further detention was not required for the purposes of investigation. Granting bail to the accused, the court asked him to execute a bond for Rs.50,000/- with two solvent sureties each for the like sum to the satisfaction of the jurisdictional court. He was also directed by the Court to appear before the investigating officer of the Agali Police Station, Palakkad District on all Saturdays at 11.00 a.m. until filing of final report, and asked not to interfere with the investigation or to influence any witness in the abovesaid crime. It was also stipulated that the accused would not involve in any other crime while on bail.The Court stated that if any of the conditions stipulated were found to be violated by the petitioner accused, the investigating officer may file an application before the jurisdictional court, for cancellation of bail.Case Title: George Jose P.J. v.
