Madras High Court Extends Life Of Remands, Bails, Paroles, Interim Orders Till July 15

The Madras High Court yesterday resolved to extend interim orders subsisting as on April 30 till July 15. Earlier, the validity of these orders was extended till June 30 (vide order dated May 17).A Division Bench of Chief Justice Sanjib Banerjee and Justice Senthil Ramamoorthy pronounced the order yesterday and thereafter, listed the matter on July 12, 2021 for further consideration.The order includes all remand as the Court's order observed, "Since it may not be able to produce remand prisoners under Sections 167 or 307 CrPC before courts either in -person or via VC, all remands stand extended till July 3". The Court clarified that this direction would apply without prejudice to the rights of the affected person to be released on bail in the meantime.Interim Orders extendedThe interim orders passed by the Madras High court both at the Principal Seat and the Madurai Bench subsisting on April 30 shall stand extended till July 15, unless vacated or modified earlier, or judicial order to the contraryOrders of dispossession, eviction, demolition not executed till date shall remain in abeyance till July 15 unless the stay is expressly vacated or expressly modified by forumAll orders passed by courts having criminal jurisdiction having granted bail, anticipatory bail, or parole etc for a limited period which are likely to expire on or before June 30, 2020 shall stand extended to July 15, 2021 subject to orders passed by relevant fora even prior to expiry of such date or thereafter, to enable the Courts to deal with any abuse of orders.Other directionsThe aforesaid directions will be subject to Orders to the contrary passed by the Supreme Court in individual mattersIn case of extreme hardship, the party aggrieved may apply for discharge or discontinuation thereof before the relevant courtInterim orders not of a limited duration shall continue to operate and remain unaffectedEncroachment drives or measures taken for recovery of revenue or demolition or eviction should as far as practicable not be taken by the state and temporarily kept in abeyance except with the previous advice of Advocate General
