    Lawyer and Uttar Pradesh BJP Spokesperson Prashant Kumar Umrao has approached the Madras High Court for anticipatory bail in an FIR lodged by the Tamil Nadu police against him for allegedly spreading false information on the alleged attacks against the migrant workers from Bihar in Tamil Nadu.

    The FIR was registered under Section 153, 153A, 504 and 505 of the IPC. Justice GK Ilanthiraiyan has sought a counter affidavit from the Thoothukudi police and adjourned the plea.

    On February 23, Umrao posted a tweet claiming that: “15 people of Bihar were hanged in a room in Tamil Nadu for speaking Hindi and 12 have sadly died. After that, Tejaswi Yadav shamelessly celebrated birthday party with Stalin in Tamil Nadu”. The police have booked Umrao for the tweet.

    In his plea for anticipatory bail, Umrao has claimed that the false complaint was given against him on account of political vendetta. 

    "Admittedly the petitioner is not the creator of such tweets and even the alleged forward of such tweet was not within his knowledge and the law is settled that in so far as the forwarding of hatred/offending messages are concerned, it is only the creator of the same is responsible for a criminal liability," he has said.

    Umrao has further argued that even assuming the tweets were seen by lakhs of persons, no untoward incident or group clashes have occurred between the communities of the two states and thus, the messages do not attract the ingredients for promoting enmity between groups.

    Umrao had earlier approached the Delhi High Court seeking transit anticipatory bail. The court granted him 13 days transit bail on the condition that he will keep his mobile number operational at all times and send his live google pin location to the Tamil Nadu police.
