The Uttar Pradesh Government last week informed the Allahabad High Court that it has taken into custody, the principal of the school where a 16-year-old girl of Mainpuri was found hanging in the year 2019.AgarwalEssentially, the Bench of Chief Justice Rajesh Bindal and Justice Piyush Agrawal is dealing with a Public Interest Litigation (PIL) plea filed in connection with a case regarding the death of a 16-year-old girl from Mainpuri who was found hanging in her school in the year 2019.On multiple occasions during the hearing of this case, the Court has expressed its displeasure with the way the matter is being probed by the Uttar Pradesh police (read earlier reports here, here, here, and here).On December 16, 2021, the Court was told that on two occasions i.e. on December 6, 2021, and December 14, 2021, the mother of the deceased had gone to the Court, however, her statement under Section 164 CrPC could not be recorded for the reason that on December 6, 2021, the Judicial Officer was on leave whereas on December 14, 2021, there was no work in the Court because of bereavement. However, it is submitted that she can appear in Court on any date for getting her statement recorded under Section 164 Cr. P.C.In view of this, the Court issued the following direction:"Let the mother of the deceased appear in the Court of Magistrate on December 22, 2021 for getting her statement recorded under Section 164 Cr. P.C."With this, the matter has now been adjourned to January 11, 2022.Background of the caseThe matter in hand relates to a 16-year-old girl from Mainpuri who was found hanged in her school. Although the police had initially claimed that it was a case of suicide, the 16-year old's mother, on the other hand, had alleged that she was harassed, beaten and assaulted, and thereafter hanged.Earlier, on September 16, during the hearing of this very case, the Allahabad High Court had asked the Uttar Pradesh government as to whether it has issued an order directing the investigating officers to comply with Section 173 of CrPC mandating the completion of investigation of sexual offences within a time frameRecently, the Court had pulled up the investigating officer when he could not explain the delay in interrogating the accused in the case while remarking that this lag occurred despite serious allegations against the accused.
