Script Copy Row: Mumbai Court Refuses To Stay OTT Release Of 'Dhurandhar' Movie In Filmmaker Santosh Kumar's Suit

A civil court in Mumbai on June 4, refused to stay the Over The Top (OTT) release of Bollywood fim Dhurandhar 2 as demanded by filmmaker Santosh Kumar, who has accused the film's director Aditya Dhar of "copying" his original script.
Judge Yunus Kharadi rejected the plea for ad-interim relief filed by Kumar, seeking stay on the OTT release of the film.
The judge noted that Kumar suppressed a similar plea filed before the Karnataka High Court, which while dismissing his plea had granted him the liberty to avail an appropriate remedy in accordance with law before the Competent Forum.
"But that fact was not disclosed by the plaintiff, that will prima facie show that he has not come with clean hands," the judge said in the order.
Further, the court noted the contentions of Dhar, who pointed out that though Kumar sought directions against OTT platform, it has not made any OTT platform, a party to the instant suit, especially the Reliance Group which controls the OTT platform - Jio. The court further noted that the first part of Dhurandhar had already released on OTT platform and the second part too released today itself (June 4).
"Prima facie it also shows that the defendant has created a third party right and from the plaint and documents, no such comparison was produced by the plaintiff to show the similarity of script and dialogues and unless and until that is verified the relief of injunction and appointment of the Court of Commissioner cannot be granted," the court said. In its order, the court made it clear that the balance of convenience lies against Kumar as he failed to produce material to support his case.
"Hence, if ad interim relief is granted in favour of plaintiff, it will cause irreparable loss to the defendants. If the plaintiff is succeeded in the suit, he can claim compensation, hence no irreparable loss would be caused to him," the court held.
With these observations, the court rejected the plea for ad-interim relief.
