A Special Court on Friday (09th October) called for the report of Superintendent, Taloja jail, after a 23-year-old undertrial (Abdel Basit Parihar), was unable to take an online exam despite the Court's order (delivered on 06th October).

Notably, Abdel Basit Parihar is an architecture student in a city college and he was arrested in the alleged drugs case, along with 20 others, including actor Rhea Chakraborty and her Brother Showik Chakraborty.

Court allowed him to appear for Exams from Jail

On Tuesday (06th October), Parihar's Advocate had submitted before the Court that he is studying B. Architecture and he is taking education in Rizvi College.

It was submitted that the applicant had to appear for 10th Semester examination. The examination was scheduled on 8/10/2020 at about 14.00 to 15.30 hours through online mode. The examination was before a Final Jury (external).

It was contended that this was his last Semester and if the permission is not given for examination, his entire career would be affected.

It was further submitted that the father of the applicant be kindly allowed to supply him study material and documents in the jail.

To this, the court had directed authorities at Taloja jail, where he is presently lodged, to make necessary arrangements for the same.

The Court had passed the following specific orders:-

    A. Jail Superintendent of Taloja Central Prison is hereby directed to permit the applicant Abdel Basit Parihar to appear for his examination which is scheduled on 8/10/2020 at around 14.00 to 15.30 hours through online on Google Meet.

    B. Jail Superintendent of Taloja Central Prison is directed to make necessary arrangement and provide facility for online examination to the applicant Abdel Basit Parihar.

    C. Father of the applicant i.e. Rizvan Parihar is permitted to give study material to the applicant in Taloja Central Prison
Parihar was unable to take exam

As per the Report of The Indian Express, on Friday (09th October), Parihar's father informed the court that his son could not give the exam, as the prison authorities claimed that there was no internet service in the jail due to technical difficulty.

On Friday (09th October) itself, Advocate Taraq K. Sayyed for Parihar filed an application for taking the matter on board and an application for calling report from Taloja Jail Superintendent stating the reason as to why the applicant (Abdel Basit Parihar) was unable to appear for his online examination.

Order by the Court - The Special Judge G B Gurao then directed the superintendent of Taloja Jail to file a report as to why Parihar was unable to appear for his online exam.

Notably, Speaking to Live Law, Abdel Basit Parihar's Lawyer Tariq K. Sayyed said that due to the negligence of the Authorities at Taloja Jail, his client Abdel Parihar has now lost one year of his career.

Notably, narrating the chronology of events, Advocate Sayed also said that on Aug 28, Abbas Lakhani and Karan Arora were arrested with 13 grams of ganja. They have been granted bail, however, based on their statements, on Sep 2, Abdel Basit Parihar was arrested.

Notably, in an application filed on Tuesday (13th October) before the Special Court, it was submitted on behalf of the Applicant/Parihar before the Court that the applicant called the Advocate on Monday (12th October), and told that he was made to sit in the exam hall for a few hours, but the officer in-charge had gone for lunch at about 1:30 pm and returned only at 04:30 pm on Thursday (08th October), due to which the applicant missed his exam.

It was prayed before the Court that strong action may be taken against the Taloja Jail authorities because of whom the applicant was unable to appear for the exam and he lost a year. It was also requested that contempt proceedings be initiated against the defaulting authorities.

It may be noted that on Wednesday (07th October) his bail application was rejected by the Bombay High Court
