    The National Company Law Appellate Tribunal, New Delhi, has released a Standard Operating Procedure (SOP) dated 15.07.2022 for conduct of physical hearing before the NCLAT Principal Bench, New Delhi from 01.08.2022 onwards. The SOP has been released exclusively for the hearings before NCLAT Principal Bench, New Delhi and the decision to resume physical hearing has been taken in light of declining COVID-19 positivity rate.

    As per the SOP, entry into the court room of the NCLAT Principal Bench has been restricted to:

    • Only one Advocate per party whose case is listed for hearing that day and whose vakalatnama is on record or who has been duly authorized by such Advocate to appear;
    • Senior Counsel engaged by any such Advocate; and
    • Registered Clerk only for the limited purpose of delivering heavy and bulky case files of such Advocates at the designated Court Room. Such Clerk shall leave the Court Room and shall enter again only to recollect the same.

    It has been further stated that entry in the Court Rooms shall be permitted to those Senior Counsels/Advocates whose matter is called out for hearing and also for the Advocates whose item is the immediate next, subject to availability of space. Once the matter is over, learned Advocate shall be required to immediately leave from the designated exit point. Further, the display boards shall be functional for convenience and information.

    The entrants have been mandated to follow the COVID-19 protocols such as wearing of mask, thermal screening, frequent use of hand sanitizer and maintaining physical distancing while entering the NCLAT premises and the Court rooms. Persons displaying symptoms of flu, fever, cough etc. have been requested to not attend the Court.
