    Dhyandev Wankhede, father of NCB officer Sameer Wankhede has challenged the single judge's order refusing to restrain NCP leader Nawab Malik from posting against his family in the defamation suit.

    Advocate Arshad Shaikh for Wankhede mentioned the matter before a division bench of Justices SJ Kathawalla and Milind Jadav on Wednesday.
    The court has granted circulation for tomorrow.
    On Monday, Justice Madhav Jamdar refused ad-interim relief to Dhyandev in his Rs. 1.25 crore defamation suit against Malik.
    However, the court directed Malik not to post statements without verification.
    The court observed that while Malik's statements appear to be driven by malice, he has raised very important issues concerning the acts and conduct of Sameer Wankhede who is a public official.
    "It cannot be said that the Defendant(Malik) has acted after reasonable verification of the facts, however, at this prima facie stage and on the basis of material on record, it cannot be said that allegations made by the Defendant are totally false," the court observed.
    Wankhede now claims that once the bench observed that the statements were driven by malice, then injunction should've been granted.
