The Special Court on Monday was informed that State Cabinet Minister and NCP leader Nawab Malik was "seriously" unwell and admitted to JJ Hospital.

Special Judge RS Rokade directed the Enforcement Directorate to get a report from JJ Hospital regarding its facilities after Malik's advocate sought for the Minister to be admitted at a private hospital.

The Minister was arrested by the Enforcement Directorate on February 23, 2022 in a money laundering case alleging his "involvement in terror funding" based on a 1999- 2005 land deal concerning Dawood Ibrahim's sister, Haseena Parkar.

Last week Malik had sought temporary medical bail claiming that he was unwell due to his various ailments.

Today, Malik's counsel Advocate Kushal Mor informed the court that Malik was shifted to JJ Hospital at 12pm today and that his condition was "serious." Mor further said that there was no facility to conduct some of the tests for Malik's treatment and sought a private hospital stay.

However, SPP Shriram Shirsat along with Advocate Sunil Gonsalves For ED said that a report may be placed before the court from JJ Hospital officials stating that they would not be able to treat Malik.

"Considering the aforesaid facts, it is necessary to call [for a] report from the medical officer of sir J.J. Hospital about the medical condition of the accused. The ED officer is directed to collect the report from the medical officer of Sir J.J. Hospital and verify as to whether there are [adequate] facilities to conduct all tests necessary for the treatment of the accused."

The court also allowed Malik's daughter to meet him in hospital.

The bench then adjourned the matter for hearing on Thursday.

    The Case

The ED has alleged that Malik connived with D-gang members i.e. Haseena Parker (late), her drive Salim Patel (late) and Sardar Khan (1993 bomb blast convict), and usurped one Munira Plumber's 3 acre ancestral property in Kurla for Rs 20 lakhs despite ready reckoner rate of Rs 3.54 crore between 2003-05.

According to the agency a power of attorney given by Plumber to Patel and Khan for removing encroachments on her land was misused to sell the property to a company owned by Malik's family.
