Orphan Lady Seeks Gujarat High Court's Direction To State Govt To Issue Her 'No Religion, No Caste' Certificate

A 36-year-old orphan lady from Surat, Kajal Manjula has moved a writ petition before the Gujarat High Court seeking a specific direction to the State Government authorities to issue her a special 'No Religion, No Caste' certificate.The petitioner has sought this direction in the larger interest of justice as she has averred in her plea that Society as well as her family make her suffer a lot and therefore, she decided to get a Special 'No Religion, No Caste' Certificate.Interestingly, the petitioner-Kajal Manjula has mentioned in her plea that she has to face day-to-day troubles in her life due to the discriminatory Caste system in the country even though she belongs to the Rajgor Brahmin community."...there are a lot of people in our country who are badly treated due to such discriminatory Caste system in our country and society and therefore, in the larger interest of Nation and in the larger interest of public, such revolutionary steps to get the certificate mentioning "No Religion, No Caste" should be welcomed for the advance Development of our society as well as our country, because due to this discriminatory Caste system in our country and society, our society, as well as our country, cannot develop properly and therefore, if such discriminatory Caste System shall be out from the society, as well as from our country, then our country, as well as our society, will be more powerful than the present time," the plea states.The plea further submits that the petitioner does not want any religion or caste to be mentioned in any where in the future and therefore, she had earlier applied before the Gujarat Government Gazette for removing her surname, and the said application was allowed and a certificate in that regard was also issued to her.The petitioner has also referred to the case of Sneha Prathibraja, who, as per the plea, hails from the state of Tamilnadu, and is the only lady in the country, who has been given such a special 'No Religion, No Caste' certificate by the concerned authority after a Specific direction was issued by Madras High Court in that regard.The plea further argues that no one would suffer, if such a revolutionary Certificate mentioning 'No Religion, No Caste', is issued to her and hence, she specifically prays for the following direction:"Your Lordships may be pleased to issue writ of mandamus or any other writ, order, or direction to the Respondents Authorities for issuing 'No Religion, No Caste Certificate' to the present petitioner, in the larger interest of justice."The Petitioner [residing at Shelter Home for Urban Homeless, Surat] has made the State of Gujarat, Dist. Magistrate and Collector, Surat and Secretary, Chorwad Nagar Panchayat, Dist. Junagadh as party respondents in the matter. The plea has been moved through Advocates Dharmesh C. Gurjar and Rekhaben C. Gurjar.
