Plea Before Lucknow Court Seeks FIR Against Robert Vadra Over Remarks On Pahalgam Terror Attack

A petition has been moved before a Magistrate Court in Uttar Pradesh's Lucknow seeking a direction to the police to lodge a First Information Report (FIR) against businessman and husband of Congress MP Priyanka Gandhi, Robert Vadra, in connection with his recent remarks on the Pahalgam terror attack. The petition, moved by Kuldeep Tiwari, convener of the Hindu Front For Justice, claims that in his alleged statements, Vadra held the entire Hindu society responsible for the said incident through various print and live news channels and social media. The plea states that the alleged statements by Vadra constitute various offences under Bharatiya Nyaya Sanhita (BNS) including sections 299 [Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs], 302 [Uttering words, etc., with deliberate intent to wound religious feelings of any person.], 152 [Act endangering sovereignty, unity and integrity of India]. The petitioner states that the present petition has been filed several days after he initially filed a written complaint with the Station House Officer (SHO), Hazratganj Police Station, Lucknow. When no action was taken, he subsequently submitted an application to the Director General of Police, Uttar Pradesh, and also sent a copy by registered post to both the Commissioner of Police (Lucknow Central) and Hazratganj Police Station. Despite these efforts, no effective action was taken, which suggests a lack of seriousness on part of the police in addressing a matter that has implications for national peace, unity, and harmony, the petition adds. It may be noted that this petition has been filed just days after the Allahabad High Court disposed of a Public Interest Litigation (PIL) seeking a Special Investigation Team (SIT) probe into the alleged remarks by Vadra. A bench of Justice Rajan Roy and Justice Om Prakash Shukla asked the petitioner [Hindu Front For Justice (through its President, Advocate Ranjana Agnihotri)] to avail alternative remedies under the law, including but not limited to filing an FIR or a criminal complaint. The PIL plea claimed that Vadra's 'provocative' speech had created an atmosphere of fear and unrest among the Hindu community, which attracts Sections 152, 302, and 399 of the Bharatiya Nyaya Sanhita.
