A Bharatiya Janata Party leader and an Advocate, Priyanka Tibrewal has moved Calcutta High Court seeking reinstatement of the aggrieved persons and appropriate compensation for such people who were affected by the Post Poll violence in the State of West Bengal.

Priyanka Tibrewal was a BJP candidate from Entally constituency in the 2021 West Bengal Assembly elections.

The plea also urges that investigation be carried out in the most expeditious and time-bound manner to find out the real perpetrators of such atrocities and it further prays that police teams be posted in the violence affected area and they be monitored by the High Court.

    Averments in the Plea

The petitioner stated in her petition that she was filing the plea in the collective interest of the public, towards ensuring that the criminal justice system works in a non-partisan manner and investigation is carried out fairly to bring to book the real culprits of such atrocities being meted out.

She has further in her plea,

"The ruling party goons have resorted to the worst form of moral depravity. The aggrieved persons' attempt to complain to the local police has been met with deaf ears."

She has averred that she had written to the police by letters dated 3rd May , 2021 and 4th May, 2021, and despite such intimation, there has been absolute inaction on the part of the police.

Further, stating that there has been rampant vandalism and houses and shops of aggrieved persons are being destroyed in broad daylight, the plea submits,

"On the past two occasions, whenever such a complaint was made to the police the same used to be instantly forwarded to the ruling party goons who would then harass the listed aggrieved persons all the more. This indicates that the police is hand in glove with the ruling party goons."

    Lastly, the plea submits,

"It is in contravention of Articles 14, 15, 19 and 21. On behalf of the people of Entally, the petitioner urges the court to take immediate action to redress such instances of flagrant lawlessness in the state. The petitioner states that the people of Entally are in a state of absolute helplessness as the police and the authorities have done nothing in this regard. If no action is taken on an urgent basis, it will shake the belief of the people of the state in their own mandate, their own choice – i.e., bringing the AITC to power."

The plea seeks direction to the Deputy Commissioner of Police and officers in charge of the concerned police stations for immediate ceasing of such atrocities and urgent filing of F.I.Rs against such perpetrators.

The Calcutta High Court will be hearing the plea next week.

In related news, a Public Interest Litigation petition has been moved before the Calcutta High Court seeking urgent reliefs in relation to the State of West Bengal in view of the widespread violence and disruption of law and order that has erupted in the aftermath of the assembly elections.
