The High-Powered Election Supervisory Committee for Rajasthan Bar Council Elections directed that the names of the candidates on the ballot papers shall be printed in the sequence of their enrolment dates, as per the past practices, without any categorization of senior advocates and advocates.
The direction came in the background of an issue raised by the Secretary, Bar Council of Rajasthan, in the background of the final list of candidate published for the elections that categorized advocates into two- senior advocates and advocates. It was contended that the same was contrary to the past practices.
The Committee observed that even though there was no rule prohibiting such categorization, as per the past practices, the candidates' names have always been printed on the ballot papers in the sequence of their enrollment.
Based on the Committee's inquiry regarding the status of ballot papers, it was stated that the ballot papers were given for printing but were not printed yet.
In this light, the Committee opined that the names shall be printed as per the established past practices, without any categorization of senior designation, on the ballot papers.
The Committee also took note of such categorization made in elections of Bar Council of Punjab and Haryana, however, it was stated that since the matter did not reach the Committee, no opinion was given on the same.
Further, the Committee directed the Bar Council of India to communicate the order to all High-Powered Committees and the State Bar Councils to prevent any anomaly.
