    The Bombay High Court on Thursday asked the Maharashtra Government and Mumbai District Caste Certificate Scrutiny Committee to file its reply in two weeks in a petition by former NCB officer Sameer Wankhede challenging the locus standing of state cabinet minister Nawab Malik, who filed the complaint against him.

    In a separate petition, Wankhede has also challenged the show cause notice issued by the caste committee pursuant to Malik's complaint.

    Malik alleged that Wankhede had submitted a false and fabricated caste certificate to the Union Public Service Commission at the time of taking the central services examination and seeking appointment against a post reserved for scheduled caste.

    On Thursday, the matter was heard by the division bench of Justices RD Dhanuka and Madhav Jamdar.

    Advocate RK Mendadkar appearing for Malik raised a preliminary objection to the maintainability of the plea. He said that since the entire cause of action arose in Mumbai, therefore the petition should have been filed on the original side.

    Despite observing that the court had both the original and appellate side assignment, the bench agreed with Mendadkar and granted Wankhede liberty to amend the petition accordingly.

    The court has clubbed both petitions filed by Wankhede and then directed the first two respondents to file their responses within two weeks. Following this, the bench then adjourned the matter for hearing on July 4, 2022.
