Delhi Riots: Court Finds Sharjeel Imam Violated Interim Bail Conditions By Being Present During Brother's Media Interview

Imam's bail is due to expire today.
A Delhi court on Saturday held that accused in the Delhi riots larger conspiracy case Sharjeel Imam, has flouted the conditions imposed on him while granting interim bail to attend his cousin's wedding functions.
Additional Sessions Judge Sameer Bajpai of the Karkardooma Courts passed the order on an application filed by the Delhi Police seeking cancellation of Imam's interim bail.
The court found that Imam was present in a room when a media person from ANI interviewed his brother, thereby violating the condition prohibiting him from coming into contact with media persons.
Imam was granted interim bail for seven days, from October 4 to October 10, to attend the marriage functions of his cousin.
One of the conditions imposed by the court was that he would not use social media or come into contact with any media person. He was also prohibited from meeting anyone other than his family members, relatives and friends.
Seeking cancellation of interim bail, the prosecution relied on videos circulated on YouTube and social media platform X, alleging that Imam had violated the bail conditions.
Opposing the application, Imam's counsel argued that he had neither given an interview nor interacted with any media person or news agency during the interim bail period.
It was also contended that the video relied upon by the prosecution was a compilation of clips from different sources and that the interview was given by Imam's brother, who was not subject to any such restriction.
The court, however, examined the videos and rejected the defence contention that Imam was not present when his brother was being interviewed.
It noted that the different portions of the video showed the same room and appeared to have been recorded at almost the same time.
The court further observed that the portions showing Imam and the interview being conducted bore the ANI logo, indicating that they had been shot by the same media person.
“Thus, apparently the accused has flouted the term ii of the bail order dated 22.09.2026, whereby he was granted interim bail,” the court held.
On the question of cancellation, the court noted that Imam's interim bail was due to expire today and he was required to surrender before the jail authorities by the evening.
His counsel submitted that Imam had already boarded a flight and would reach Delhi in the evening to surrender.
The Police cited violation of the condition which said that during the interim bail period, Imam shall not use social media and will not come in contact of any media person.
In its application, the Police said that a video is circulating on social media in which Sharjeel Imam can be clearly seen interacting with the media persons during the period of interim bail.
”Therefore, the accused grossly violated the aforesaid condition that he shall not come in contact of any media person,” the plea stated.
It added that the said conduct of Imam is wilful and deliberate, and amounts to a gross violation of the express condition of interim bail imposed by the Court.
“The accused, having been granted the indulgence of liberty, was bound to abide by the conditions attached thereto, and has abused the said liberty and indulgence of this Hon'ble Court. It is clear from the conduct of accused that he is misusing the liberty granted to him by this court,” the plea said.
Earlier, Imam was granted interim bail for 10 days, from March 20 to March 30 to attend his brother's wedding.
The accused, who were student activists in the forefront of organising anti-Citizenship Amendment Act protests in 2019-2020, are facing charges under the Unlawful Activities Prevention Act and the Indian Penal Code for allegedly formulating the "larger conspiracy" behind the communal riots which took place in the national capital in the last week of February 2020.
The accused in the case are Tahir Hussain, Umar Khalid, Khalid Saifi, Isharat Jahan, Meeran Haider, Gulfisha Fatima, Shifa-Ur-Rehman, Asif Iqbal Tanha(granted bail in 2021), Shadab Ahmed, Tasleem Ahmed, Saleem Malik, Mohd. Saleem Khan, Athar Khan, Safoora Zargar(granted bail on humanitarian grounds as she was pregnant when arrested), Sharjeel Imam, Faizan Khan, Devangana Kalita (granted bail) and Natasha Narwal(granted bail).
