    The Sikkim High Court on Thursday directed the State government to file a report on the status of compliance with the provisions of the Rights of Persons With Disabilities Act, 2016, particularly Sections 33 and 34 that deal with identification and reservation of posts for specially abled.

    The directions were made by a bench comprising  Chief Justice Shri Biswanath Somaddar and Justice M.M Rai while hearing a Public Interest Litigation filed by one Navraj Tiwari, claiming to be a social worker.

    Tiwari sought to invite attention of the court towards alleged non-compliance of Section 33 of the Act, that mandates a constitution of an expert committee for identification of posts that can be held by persons with disabilities.

    Simultaneously, the petitioner also pointed towards the non-compliance of Section 34 of the Act which mandates 4% reservation for persons with disabilities in Government Jobs.

    After considering the arguments put forth by the counsel of the petitioner the bench directed that a status report be filed within 6 weeks, stating therein specifically as to whether the State of Sikkim has complied with the provisions of sections 33 and 34 of the Rights of Persons with Disabilities Act, 2016, or whether they are in the process of taking steps towards complying with the said provisions.

    The bench listed the matter again after six weeks for further consideration.
