    The Shahi Idgah Mosque Committee on Monday filed an application before the Mathura Court objecting to the Court's last month's order for a 'survey' of the mosque premises in connection with the Sri Krishna Janmasthan-Shahi Idgah dispute case. 

    In its order, Civil Judge III Sonika Verma had directed the Civil Court Amin (also known as court officers) to visit and survey the disputed site and submit a report (with maps) before the Court by January 20.

    The order was passed while adjudicating upon a plea moved by Vishnu Gupta, National President of Hindu Sena (through Advocate Shailesh Dube) in a suit filed by him seeking possession of the Shahi Idgah premises and demolition of the present structure situated there.

    Objecting to Court's order, the Mosque committee has questioned the locus of the petitioner (Gupta) and has stated that the committee was neither presented with a copy of the plea, nor it was heard before the Court passed the order.

    It may be noted that in the suit in question, plaintiff Gupta has challenged the ownership of 13.77-acre land on which the Idgah is built. The suit states that the Idgah was constructed by Aurangzeb on the 13.37 acres of Shri Krishna's birthplace after demolishing the Sri Krishna temple.

    In view of this, the suit seeks the cancellation of the agreement between Sri Krishna Janmasthan Seva Sangh and Shahi Idgah executed in the year 1968, calling it illegal.

    It may further be noted that this suit is one of the many suits filed before the Court demanding the demolition of the 17th-century Shahi Idgah Masjid claiming the same to be built on Krishna Janambhumi's property. Shailesh Dube.

    In related news, the Allahabad High Court has directed Mathura Court to expeditiously decide on an application filed before it for conducting a Scientific Investigation of Shahi Eidgah and Jahanara's Masque in connection with a 2021 suit (Bhagwan Shrikrishna Virajman and others vs. U.P. Sunni Central Waqf Board and others).

    In related news, a Mathura court in May 2022 held that the suit to remove the Shahi Idgah Masjid, allegedly built on the land of Shrikrishna Janam Bhoomi is maintainable. With this, the Court overturned a civil court order dismissing the suit in September 2020.

    It may be noted that Mathura's Shahi Idgah Masjid is located next to the Krishna Janmabhoomi, which is believed to be the birthplace of the Hindu deity Krishna.
