    The Allahabad High Court's May 12 order directing a local court in Mathura to decide two applications pending before it, filed in connection with the Sri Krishna Janambhumi Dispute, within 4 months, has been submitted before the Mathura Court yesterday.

    The order has been submitted by Manish Yadav, one of the plaintiffs who has moved a suit before the Mathura Court seeking to shift Shahi Idgah Mosque, claiming that it is built at the birthplace of the deity, within the 13.37-acre premises of the Katra Keshav Dev temple.

    Speaking to Live Law, petitioner Yadav, and his Counsel Deepak Sharma confirmed that they have filed the copy of the HC's order and the Court has asked them to present the same on July 1, the day, when it will hear the case.

    On May 12, the HC's Bench of Justice Salil Kumar Rai had issued the following order on a plea made by Bhagwan Shri Krishna Virajman And Another:

    "The Civil Judge (Senior Division), Mathura is directed to decide the aforesaid applications expeditiously preferably within a period of four months from the date a certified copy of this order is produced before him and after giving an opportunity of hearing to the affected parties, in case there is no legal impediment in deciding the aforesaid applications."

    It may be noted that Yadav, the next friend of the petitioner Bhagwan Shri Krishna Virajman, has already filed two separate applications in the district court of Mathura [under Order 39, Rules 1 and 2 and under Order 4-A, Rule 1 of the Code of Civil Procedure].

    The High Court had, on May 12, ordered to dispose of both these applications within four months.

    Essentially, in the first application [filed under Order 39, Rules 1 and 2 CPC], an order of temporary injunction has been prayed for to ban the entry of opposite parties (U.P. Sunni Central Waqf Board and others) at the disputed place.

    Whereas, in the second application [filed under Order 4-A, Rule 1 CPC], a prayer for clubbing and hearing of all the cases filed in connection with the Sri Krishna Janambhumi Dispute in the district court of Mathura has been made.

    In related news, a Mathura court on May 19, held that the suit to remove the Shahi Idgah Masjid, allegedly built on the land of Shrikrishna Janam Bhoomi is maintainable. With this, the Court overturned a civil court order dismissing the suit in September 2020.

    It may be noted that the Mathura's Shahi Idgah Masjid is located next to the Krishna Janmabhoomi, which is believed to be the birthplace of the Hindu deity Krishna.

    Significant, a suit had been filed seeking the removal of the Shahi Eidgah (mosque), adjacent to the Shri Krishna temple complex in Mathura, and the transfer of 13.37-acre land to the deity.

    However, a civil court in Mathura (U.P) on September 30, 2020, had refused to admit a suit that sought to remove the Idgah mosque on the allegation that it was built over the Krishna Janam Bhoomi, the birthplace of Lord Krishna.
