    The Allahabad High Court recently remarked that the State Education Department and its officers are not attending to the grievances that are raised against it and that they are performing their duties in a very casual manner.

    With this observation, the Bench of Justice Rohit Ranjan Agarwal directed the Principal Secretary, Basic Education, Government of Uttar Pradesh to ensure that all the District Basic Education Officers start performing their duties promptly and to take the final call on all the matters which come before them for consideration at the earliest.

    Failing this, the Court warned, it would take stringent action against these defaulting officers.

    Essentially, the Court was dealing with a writ petition seeking a direction upon the District Basic Education Officer, Auraiya to decide the representation filed by one Avaneesh Kumar, whose posting order has been withheld by the District Basic Education Officer for the last one year.

    The Petitioner informed the Court that on March 6, 2021, he had moved the representation before the District Basic Education Officer, Auraiya ventilating his grievance, however, it had not been attended to by the officer concerned.

    Against this backdrop, the Court observed that it is high time that these officers of the State Government start working and attend to the grievances which come before them through representations within a period of one month.

    Regarding the instant case, the officer concerned was granted one last opportunity of three days to make the decision on the representation of the petitioner which is pending before him since March 6, 2021.

    The Court also made clear that the officer, concerned shall make every endeavor and decide all the applications/representations pending before him moved by the teachers and other teaching staff of various institutions over which he exercises his control within a period of three weeks.

    Lastly, the Court posted the matter as fresh on 28th January 2022, on which date, the counsel appearing for District Basic Education Officer, Auraiya has been directed to inform the Court about the decision taken on the representation and sought an affidavit from him.
