    The Allahabad High Court has directed the Uttar Pradesh Government to see to it that in all the State Medical Colleges of the State, senior-level posts are timely advertised and vacancies are filled expeditiously as it directly affects the teaching of the students.

    The bench of Justice Alok Mathur issued this order as it noted that there is an acute shortage of senior staff in two medical colleges of the State, and thus, the Court thought it fit to direct the UP Government to deal with the situation.

    Essentially, the Court was dealing with the writ plea of one Dr. Yasmeen Usmani, who is presently posted at Shaikh-Ul-Hind Maulana Mahmood Hasan Medical College, Saharanpur as a Professor in the Radio-Diagnosis Departmentand.

    She submitted before the Court that by means of the impugned order dated 24.08.2021, she has been directed to perform duties for four days in a week at the Medical College, Meerut while the remaining two days, she will have to work at Saharanpur.

    Her counsel informed the Court that this arrangement has been made on account of the fact that between both the medical colleges, the petitioner is the only Professor in the RadioDiagnosis Department and consequently, due to acute shortage of vacancy of specialist in the field of Radio-Diagnosis Department, the services of the petitioner has been divided in the two medical colleges.

    It was her plea before the Court, she contended that being a lady, commuting 150 km twice a week is a heavy burden, and consequently, she prayed that she may be permitted to resume and continue with her services at Medical College, Meerut.

    The Counsel for the respondent, State Of UP, on the other hand, supported the impugned order stating that the same has been passed in the public interest as well as in the interest of the patients.

    The Court disposed of the plea with a liberty to the petitioner to make a fresh representation before respondent No. 1/Principal Secretary, Medical Education, Government of U.P., Lucknow within two weeks' and in case a representation is made before respondent No. 1 within the aforesaid time, then the same shall be considered and decided in accordance with law expeditiously, within a period of four weeks thereafter

    Further, in view of the acute shortage of senior-level staff in the state medical colleges, the Court issued the following order:

    "In light of the above, respondent No. 1 is also directed to personally oversee and make sincere efforts to see that not only at Meerut and Saharnapur but in all the other State medical Colleges Senior level posts are timely advertised and vacancies are filled expeditiously as it directly affects the teaching of the students."

    This direction has been issued in conformity with the undertaking given by the State Government before the Supreme Court in the case of Writ Petition (s) (Civil) No(s). 634 of 2018 (The State of Bihar Vs. Medical Council of India & Anr.
