Refusing to grant relief to the Petitioner, the Allahabad High Court on Monday said that when the Rules pertaining to the Uttar Pradesh Higher Judicial Services did not provide, it could not direct the authorities to re-evaluate the answer sheets.

The Petitioner, Reeta Rani, was unable qualify the mains examination in the Uttar Pradesh Higher Judicial Services, 2018. In the writ filed through Advocate Sunil Kumar Pandey, she claimed that her performance in the examination was very well and on this basis, sought re-evaluation of her answer booklets.

The matter titled "Reet Rani v. Registrar General High Court, Allahabad & Anr." was being heard by the bench comprised by Justice Pankaj Mithal and Justice Saral Srivastava. The bench refused to interfere due to absence of any such provision in the exam Rules. "There is no provision under the rules or otherwise for reevaluation of the answer books. In the absence of any such rule, it is not possible to issue any direction as sought for by the petitioner", the court said.

They further advised the Petitioner that she could opt to file an RTI to see her answer books.

The Respondents were represented by Advocate Ashish Mishra.
