A PIL has been filed before the Bombay High Court seeking deferment of the implementation of Goods and Services Tax Act (GST)  till the next financial year of 2018-19.

This PIL has been filed by a 63-year-old retired professor  in the backdrop of the Centre’s big rollout of GST from July 1.

The petitioner, Dr.KS Pillai, was an Assistant Professor at King Edward Memorial Hospital in Parel. He contends that the Government is implementing “major constitutional changes of tax reforms in the middle of the financial year that too unprepared.”

Under the heading of legal questions, petition also questions whether it is “proper” for the Union of India to “ignore representations received from the public” following the recent announcement of finalization of GST rates.

According to the petition, this middle of the financial year rollout would cause much confusion and chaos amongst the general public and it might affect their daily needs like supply of essential medicines, food and drink items because of unpreparedness on part of the government.

Thus, the petitioner prays for the High Court to defer the implementation of GST “till the legal sanction for implementation, the decided rates on all varied commodities etc. is taken from the parliament in Budget session of 2018 for initiation of the new proposal from 1st April 2018.”

The matter is yet to be heard, it will come for hearing in due course of time.
