Rejecting Roy’s Plea, SC Goes Ahead With Aamby Valley Auction [Read Order]

In a huge setback to Sahara group chief Subrata Roy, the Supreme Court today said the auction of Aamby Valley will proceed as per the court’s April order and rejected his plea to put it on hold.The three judge special bench headed by Chief Justice Dipak Misra directed the registrar general of the Bombay high court to be personally present to oversee the auction scheduled to take place in Mumbai.In August, while asking the Sahara Group to deposit Rs1,500 crore in a dedicated Sebi account by 7 September, the apex court had clarified that the Aamby Valley auction process would be stopped if the company furnished the payment in time.Kapil Sibal, counsel for Sahara today sought more time for the company to deposit the money and told the court that it would submit two post-dated cheques of 11 November to ensure payment.In his plea on August 9, Roy had requested the bench to put on hold the auction .On July 25, the bench had asked the official liquidator of the Bombay High Court to proceed with the publication of sale notice with regard to auctioning of Sahara's prime property at Aamby Valley. The bench had fixed the matter for further hearing on 11 September.After the plea was mentioned by senior advocates Kapil Sibal and Mukul Rohatgi who appeared for the group, a bench, headed by Justice Dipak Misra said he would consult justices Ranjan Gogoi and A K Sikri and then fix a hearing date.The apex court had on July 25 asked the embattled Sahara chief to deposit Rs 1,500 crore in the SEBI-Sahara account by September 7 and said that it might then deliberate upon his plea seeking 18 months more time for making complete repayment.The court had simultaneously approved the draft sale notice and terms to dispose of the property prepared by the official liquidator of the Bombay High Court.
