Ramachandran: I'm not saying that...take for example transgender persons, there is a broad societal sympathy because they play a social role in our society. But this is an unpopular minority.

CJI DY Chandrachud: That's not something which the court can presume. We can't declare on how we assume the parliament would react.

Ramachandran: Triple talaq was something which shocked the conscience of people across communities. Therefore, when the court passed a declaration penalising it, it was a matter of fairly easy consensus.

Ramachandran: Those three are examples where the majority - majority as reflected in institution of legislature- would have had no serious problem at all.

Ramachandran: Apropos the observations of the bench on the possibility of giving a constitutional declaration but not more than that- leaving it to legislature- like triple talaq, transgender act, data protection 

Sr Adv Raju Ramachandran: Lack of recognition leads to the denial of equal protection of laws.

Singhvi: If your lordships wish they can consider arguments on notice and objection.

CJI DY Chandrachud: Thank you Dr Singhvi.

Singhvi: A civil union says that yes you're equal but you're equal in that kind of table. 

Singhvi: My last point- I may be perhaps guilty of slight exaggeration but I think it's an appropriate analogy. The segregation doctrine of separate by equal is what I've said here.

Singhvi: "Ultimately, the message is that what same-sex couples have is not as important or as significant as “real” marriage, that such lesser relationships cannot have the name of marriage."
