The ED took physical custody of the respondent on March 5, 2022, but he was formally arrested only on March 6, 2022, and produced before a magistrate later that day. The Court found that the respondent was not produced before a magistrate within 24 hours of being taken into custody, rendering the arrest illegal. The Court emphasized that the failure to produce the respondent before a magistrate within 24 hours violated his fundamental rights under Articles 21 (right to life and personal liberty) and 22(2) of the Constitution.
