    In a significant move, the Government of India, acting through the Department of Commerce and the Directorate General of Foreign Trade (DGFT), has issued a notification, amending the Export Policy of Non-Basmati rice. The amendment has been made against ITC (HS) Code 1006 30 90 of Chapter 10 of Schedule 2 of the ITC (HS) Export Policy.

    As per Notification No. 20/2023 DGFT, the export of Non-Basmati white rice (Semi-milled or wholly milled rice, whether or not polished or glazed: Other) under HS code 1006 30 90, previously categorized as 'Free' for export, has now been reclassified as 'Prohibited.'

    The amendment has been implemented in the exercise of powers conferred by Section 3 read with section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No. 22 of 1992), as amended, read with Para 1.02 and 2.01 of the Foreign Trade Policy, 2023.

    The new export policy will allow consignments of Non-Basmati rice to be exported under specific conditions, as outlined below:

    1. Export will be permitted if the loading of Non-Basmati rice on the ship has commenced before the date of this Notification (20th July 2023).

    2. For shipments where the shipping bill has been filed, and vessels have already berthed or arrived and anchored in Indian ports with their rotation numbers allocated before this Notification, the approval of loading will be issued only after confirmation by the concerned Port Authorities regarding anchoring/berthing of the ship for loading of Non-Basmati rice prior to the Notification.

    3. Export will be allowed for consignments of Non-Basmati rice that have been handed over to Customs before this Notification and are registered in their system, or where the consignment has entered the Customs Station for exportation before this Notification and is registered in the electronic systems of the concerned Custodian of the Customs Station with verifiable evidence of date and time stamping of these commodities having entered the Customs Station prior to 20th July 2023. The period of export under this condition shall be up to 31st August 2023.

    4. The export of Non-Basmati rice will also be permitted based on the government's permission granted to other countries to meet their food security needs and as per their specific requests.

    It is important to note that the export of Organic Non-Basmati rice will be governed by Notification No. 03/2015-2020 dated 19th April 2017, read with Notification No. 45/2015-2020 dated 29th November 2022.
