The Ministry of Commerce and Industry has taken a substantial step towards enhancing consumer safety by unveiling the Cookware and Utensils (Quality Control) Order 2023. This order, designed to regulate the quality of cookware and utensils, enforces adherence to specific Indian Standards, introduces certification and enforcement mechanisms, and establishes penalties for non-compliance.
Under the authority of sections 16, 17, and 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, following consultations with the Bureau of Indian Standards, has issued the Cookware and Utensils (Quality Control) Order, 2023.
The Order's applicability is delineated based on the categories of enterprises:
- For Micro Enterprises, as defined under the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), the regulations will be effective twelve months from the date of this notification's publication.
- For Small Enterprises, also defined under the same Act, the regulations will take effect within nine months from the date of this notification's publication.
The order mandates that all manufacturers and suppliers of cookware and utensils adhere to specific Indian Standards as outlined in the order.
This includes categories such as Stainless Steel Cookware, Wrought Aluminium Utensils, Stainless Steel Sinks for Domestic Purposes, Round Open Top Sanitary Cans for Foods and Drinks- Tinplate and Aluminium cans for beverages.
These items must also bear the Standard Mark, signifying their compliance with the stipulated standards. This mark can only be affixed under a license issued by the Bureau, following the provisions of Scheme-1 of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018.
It's noteworthy that this Order excludes domestically manufactured goods or articles intended solely for export purposes from its purview.
As per the provisions stated in the Order, the Bureau of Indian Standards is entrusted with the responsibility of being the certifying and enforcing authority for the goods or articles specified in the provided Table.
Strict consequences are in place for those who fail to comply with the stipulations of this Order. Any individual found contravening the provisions will be subject to the penalties prescribed under the Bureau of Indian Standards Act, 2016.
