SG Mehta: Just to illustrate, for example, Constitution of India amended and inserted Article 21A- Right to Education. It never applied to J&K till 2019 because this route was never followed.

SG Mehta: All were applied with modifications. For example, Art 368 was applied but with a provision that any amendment made in the Indian Constitution would not ipso facto apply to J&K unless applied through Art 370 route.

SG Mehta takes the bench through a list of States that became a part of the Dominion of India without signing a merger agreement.

He had earlier argued that signing a Merger Agreement was not mandatory for states to be fully integrated with India.

SG Mehta commences his arguments for the day.

Justice Gavai: If it's during appearance, that may be retribution...what happens to so much freedom?

Justice SK Kaul: Mr SG, the close proximity between the arguments and the order...

SG Mehta: The timing is definitely not proper, I bow down.

Sibal: This is not fair. This is not how our democracy should function.

CJI: Mr AG, just see what has happened. Someone who appears in this court is suspended now...have a look into it. Talk to LG.

CJI: If there is something else, then it's different. But why such close succession to him appearing and then getting suspended.

SG Mehta: There are other issues. He appears in various courts and there are other issues. We can place it before court.

Sibal: Then he should have been suspended earlier, why now?

SG Mehta: I have checked my lords after reading the newspapers. What is reported in the newspapers may not be the whole truth.

Sibal: I'm sure AG will look at it.
