Justice Sambre - We will continue tomorrow at 2.30 PM.

Desai - So whatever is being argued today, WhatsApp chats etc.. Bulk of the evidence they had on 2-3 October. But they did not invoke conspiracy and rightly so.

Desai points out that at the time of arrest Aryan, Arbaaz and Munmun were not booked for conspiracy.

Desai - But what happened to 29? It is the heart of the case. It is the umbrella which they open up.

Desai saying that the NCB is roping in anybody and everybody using an "umbrella charge of conspiracy".

Desai - Only reason we are here is because of one observation. That the rigors of sec 37 of NDPS apply. It's because the prosecution opened up the umbrella of conspiracy to charge anybody and everybody.

Bench now resumes hearing Arbaaz Merchant's application.

Adv Amrish Sharma also files an intervention. Says it is on similar grounds of preference given to this matter.

Justice Sambre says says whoever has any other urgent matters can mention them.

Judge says he sits till even 7 PM being sensitive to the concerns of the bar.

An advocate says he has filed an intervention to object the bail. He objects to the bail applications being taken up on priority.
