Aryan Khan, Arbaaz Merchant, Munmun Dhamecha - Bail Applications Dismissed As Non-Maintainable - LIVE UPDATES

Mumbai Court rejects bail applications of Aryan Khan, Arbaaz Merchant and Munmun Dhamecha holding that the applications are not maintainable. 

Court - Heard, considered, decisions cited, applications are not maintainable hence rejected.

Judge says that he will dictate the entire order today.

Court - I am anxious to pass the order in open court but ill give the operative part here. 

Maneshinde cites the case of Kaizan who was arrested along with Rhea and granted bail on the same day as the prosecution did not object.

Maneshinde - I am also sorry about what happened in court (With ASG), there was nothing personal. We have been friends for 38/39 years.

Maneshinde - Just because I come from an affluent family doesn't mean I'll tamper with evidence.

What influence have I used? I am suffering from the last six days.

Maneshinde says this is a case of no material against Khan.

They held me for 7 days. Even if they want to say I will tamper with evidence, they should come with a positive case of how I will do it.

Just bald allegations!

Maneshinde - All of this will arise only if I am saying the sections are bailable.

You charge me with anything, but without material I am entitled to bail.

Maneshinde says that Stefan Mueller's judgement lays down the law.

And Rhea Chalraborty's subsequent judgement goes beyond the rule of interpretation and precedence.

Says that a coordinate bench can not take a different view.

Maneshinde says Section 36A can be seen again...

"36A of NDPS Act speaks about trial, not about grant of bail. For grant of bail, Section 437 CrPC is to be seen.

Just because Section 27A is applied to the entire case, that charge cannot be foisted on me."
