    A division Bench of Justice AM Khanwilkar and Justice Dinesh Maheshwari was hearing the plea filed by Advocate Mamta Sharma seeking cancellation of the Class 12 CBSE and ICSE written exams and the plea for cancellation of Class XII State Boards, HSC and NIOS physical exams, filed by Child rights activist Anubha Srivastava and 7 others.

    On the last hearing of Adv Mamata Sharma's plea, Supreme Court had granted two weeks time to the CBSE and the ICSE to decide the objective criteria for alternate mode of assessment for Class 12 students, in lieu of the exams cancelled on account of COVID.

    Attorney General for India KK Venugopal, appearing for the CBSE, had informed the Bench about the decision taken by the Central Government on June 1 to cancel the CBSE exams and had further submitted that a decision on objective criteria would be taken within 2 weeks.

    In response to request for a uniform decision with respect to State Board Exams, a vacation bench of Justices AM Khanwilkar and Dinesh Maheshwari had observed that interests of the entire student community will be taken into account, adding that it will wait for the decision of CBSE and CISCE first, before considering other issues.

      Prashant Padmanabhan submits that Kerala has not canceled as well. 


      Bench: 24 states have cancelled the class 12 board examinations. 4 states have not cancelled. We are informed Kerala has not cancelled class 11 exams. They may be served as well.

      Bench: States of Assam, Punjab, Tripura and AP have not cancelled. Please serve the plea to them. List the matter on 21st. 


      Adgaonkar: 18 states have cancelled, 6 have conducted it. Only have not cancelled.

      Bench has started hearing the matter pertaining to the State Boards. 

      Bench directs the Counsel to serve the plea to the Standing Counsels of the States concerned.

      Order: CBSE and ICSE is free to notify the final scheme howsoever it may wish to do so and inform us on next date of hearing.

      Order: As VIKAS Singh has sought for time, we defer the hearing to Monday. The Boards can finalise the scheme in the meanwhile. If suggestions are given by Singh, they can be considered. We record that Counsels have no objection to the schemes presented.

      Order: Second is for declaration of results and when the timeline for optional exams would be declared. Both the Boards have submitted that the same will be done.

      Order: We have no reservation to accept the scheme and the Board can proceed on the same. However, the scheme must incorporate the provision for dispute resolution in case students want correction of final result declared.

      Order: Students who want to appear can do so for improvisation of marks and that takes care of the students who want to appear. In other words, no prejudice will be caused to students who want to appear.
