    The Supreme Court will hear at 1 PM the petition filed by the Central Government challenging the show-cause notice issued by the Delhi High Court yesterday for contempt action for failure to supply 700 MT per day oxygen to the National Capital Territory of Delhi.

    A bench led by Justice DY Chandrachud is hearing the matter.

    The petition was mentioned before the Chief Justice of India Justice NV Ramana by the Solicitor General Tushar Mehta today morning. The CJI assigned the matter to Justice Chandrachud's bench.

      Justice Chandrachud: We need to find a way out of this impasse for Delhi. I’ll also reflect with my learned brother if we can form a committee tomorrow itself. But, do consider names who can be on this committee. We want names from private and public sector as well.

      Justice Chandrachud: If we have a committee to relook the norms for oxygen availability pan-India, who would you suggest ? Mr. Gupta, Mr. Venugopal.

      SG: Instead of highlighting problems, problems do exist - 


      Justice Chandrachud: Though I may be presiding, I need to defer to my other two colleagues. This matter is a combination of contempt and the suo moto.

      Justice Chandrachud to SG: Please tell your ASGs to not interpret the order of this Court in this manner. The Delhi HC got upset.

      Bench: In view of the above, we stay the operation of the contempt order of the Delhi HC of 4th May. We clarify that the stay which is being granted shall not operate as an order of restraint on HC in continuing to monitor the allocation of oxygen in the proceedings before it.

      Bench: Centre Govt. place a tabulated chart indicated the manner of compliance of 700 MT with sources of supply, provisions of transportation and other logistical arrangements necessary to ensure fulfilment of requirement.

      SG: I just want to clarify that the allocation is not just on the basis of beds, but it is also on the basis of active cases. 


      Justice Chandrachud: Yeah, yeah. We understand that. We have all done maths in school. When we edit the order, we will add that.

      Bench: In a good faith measure to submit a tabulated plan before this court, we allow Centre to submit a plan by 10.30 AM tomorrow. 


      SG: Every supply will be in transit.


      Justice Chandrachud: We will not send anyone to jail if you send the figure by 2AM and not 12.
