Justice Chandrachud: The pandemic in Delhi is very critical. Our order was on 2nd of May. We are on the 5th of May. What you need to do is that tell us how much you have allocated over the past few days.

    • 5 May 2021 1:23 PM IST

Justice Chandrachud: It’s a bonafide formula, but we need to ensure that the basis for computing that instead of having a rough and ready formula, we can look at that when the matter comes up on 10.

    • 5 May 2021 1:21 PM IST

Justice Chandrachud: Now we’re looking at the interstate. You cannot have a general assessment for entire country, irrespective of the state of the pandemic. The pandemic is peaking at different times in different states.

    • 5 May 2021 1:21 PM IST

Justice Chandrachud: The formula is a based on assumptions. That 100% ICU beds require oxygen and 50% beds require oxygen. This is not the state in every State. What’s happening in Odisha may be very different from the state of the pandemic in Maharashtra or Delhi.

    • 5 May 2021 1:20 PM IST

SG: The similar is done with calculation for ICU beds. The same formula is followed. It totals up to 515.

Justice Chandrachud: A couple of things.

SG explains the allocation for oxygen for non-ICU beds.

SG states that this is the formula of GNCTD itself.

SG: 50% of ICU beds need 10 litres per minute and 100% needs 20 per minute. I’m not going back from my statement. The figure by Delhi Govt for 700 is not justified. Every State has demanded more, but allocation is based on this formula.

SG: We found out a formula applicable to the entire country. Please bear with me and have some patience.

Justice Chandrachud: Patience is what you swear to when you get into office.

Justice Shah: You may be saying that have some patience for the patients.
