The Supreme Court has called upon the Uttar Pradesh Govt. to show cause why compensation should not be awarded for the continued illegal detention of a man for 1.5 months, who was earlier ordered to be released on bail.

At the outset, a bench of Justice JB Pardiwala and Justice Manmohan termed the case to be unusual and disturbing, after noting that the applicant was still in jail, in flagrant violation of its earlier order granting him bail.

“We have a very unusual case before us. Something very disturbing and we take serious cognizance of the same.”, the bench remarked.

The accused was booked for offences punishable under Section 108 of the Bharatiya Nyaya Sanhita, 2023, and Section 66D of the Information Technology Act, 2000. He was arrested in connection with an FIR registered at Baghpat, Uttar Pradesh.

The allegations against the petitioner broadly centred around alleged cyber fraud and threats causing mental distress to the deceased, leading to his unfortunate suicide.

The petitioner's bail application before the Allahabad High Court was adjourned 12 times without an effective hearing on merits. The High Court adjourned the matter without deciding the prayer for interim/regular release on merits, aggrieved by which the petitioner moved the Supreme Court, which enlarged him on regular bail on September 28, 2026 after taking into consideration the period of custody undergone, the stage of proceedings, and the facts and circumstances of the case.

The instant miscellaneous application moved by the accused flagged the violation of the Court's bail order, as despite the Court's order granting bail on September 28, 2026, he remained in jail.

Ordering his immediate release, the bench also called upon the state “to show cause as to why appropriate compensation should not be awarded to the petitioner for his illegal detention in the custody so far, despite the fact that this Court ordered release on bail one and a half months back.”

The Court directed the Registry to forward one copy of the order to the Chief Justice of the High Court of Judicature at Allahabad.

The matter is next listed on 3-12-2026.

Mr. Praveen Kumar Jha- 3165 , AOR Mr. Ashok Kumar Jha, Adv. Dr. Ranjeet Bharti, Adv. appeared for the applicant /accused.
