Rohatgi: See the stark difference between these 9 cases and Best Bakery and Bilkis Bano. The SC did not have faith in those trials. they were transferred and after retrial there were convictions. That was not taken by SIT.

Bench: SIT was responsible for not only fair investigation but also fair trial.

Rohatgi: SIT was superimposed on the Government by the SC. Out of 8 every trial ended in conviction, life sentence including death sentence.

Rohatgi: Kindly note that even the closure was taken up by a judge on a day to day basis. So, full power is given to SIT. Item 6, 7, - faith in SIT. Item 10 again SIT. Every part is on SIT. The SIT was good then and suddenly has become biased.

Rohatgi: Then Milord, judgment I am not reading, item 7 is confirmation judgment, I have read that small quotation from that. I’ll read the recommendation of SC. [SIT did their job in 9 cases well]Therefore they (SIT) would continue to function till the end of the trial.

Rohatgi: There is no need to keep this pot boiling, your lordships should give closure. Now, let me show Vol. 2 of the compilation. I have read Vol 2 of my note, the PRO letter. The judgment from Trial Court in Gulberg, I’ll read. I read major portion from Nanavati.

Rohatgi: The finding of the HC is that the post mortem reports were proved by prosecution.

    • 1 Dec 2021 12:38 PM IST

Rohatgi: Now about post mortem. The riots in Gulberg had nothing to do with this, still SIT investigated. Kindly see the confirmation case, the argument of the defence. The argument was that there was no fire, they died because of shock, so we cannot be guilty of setting fire.

    • 1 Dec 2021 12:37 PM IST

Bench: You mean, that the fresh allegations were made which were not in the complaint.

Rohatgi: The expansion was made (by other other side) at all stages.

    • 1 Dec 2021 12:37 PM IST

Rohatgi: What they read were some testimonies in those (other 9) cases, they will be dealt with in those cases.

Rohatgi: The intention is to keep on making frivolous allegations.

Rohatgi: Then, about investigation of post mortem.

    • 1 Dec 2021 12:28 PM IST

      Rohatgi: I’ll check.

Bench [in lighter vein]: This is to reduce our stress. Such moments are necessary.

Rohatgi: Item 2. Mystery of fire is cut paste from that. The moment you cut paste you get this dot.
