    Supreme Court to continue hearing today the petition filed by Zakia Jafri challenging the SIT's clean chit to the then Gujarat CM Narendra Modi & other high functionaries in the #GujaratRiots of 2002.

    A Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar is hearing the matter.

    On Wednesday, Mr. Mukul Rohatgi, appearing on behalf of SIT, emphatically submitted that the SIT had conducted an impeccable investigation and on certain occasions went beyond their means to meet the ends of justice. Over a course of seven days, a Bench comprising Justices AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar had heard the detailed submissions of Senior Advocate Kapil Sibal demonstrating the failure of SIT in investigating the matter.

      Sibal: It is not pressed for further investigation. If tomorrow any other evidence that comes up then nothing is closed forever. I am not challenging the closure report on this finding. I am not seeking further investigation in this matter.

      Sibal: This does not require further investigation.

      Bench: So you are not challenging that finding of SIT?

      Sibal: I have not read it so I am neither relying nor disputing any of it. I have given undisputed documents and matters which require further investigation.

      Rohatgi: The other side has not pressed Item no. 1 of the complaint. I was otherwise willing to read it.

      Bench: Maybe it was that they wanted further investigation in other matters to later press this. It is not as if it was not pressed?

      Rohatgi: From 337 onwards SIT had done another exercise. It has collated different part of the report that was concerned with the 63 accused.

      Bench: They have not pressed item 1 (allegation against CM)?

      Rohatgi: Each of them examined in details. None of them had unconvincing alibi. Their telephone calls are checked. Nothing found. The allegation was not correct.

      Rohatgi: So, Milord, it was a serious allegation that between doctors that secret meeting took place at Lonavada. Ashok Bhatt and Chauhan were also there and they conspired to avenge the train burning incident.

      Rohatgi: The other side said, I have heard Mr. Sibal say - Why have you not ceased the mobile phones?

      An event of 2002, this is 2010. People don’t keep phone for 8 years, the phones were very different back then and wherever there is govt phone, it has been examined.
