    Karnataka High Court Full Bench will continue hearing on a batch of petitions challenging the hijab ban in educational institutions. 

    The matter is before a bench comprising Chief Justice Ritu Raj Awasthi, Justice Krishna S Dixit and Justice JM Khazi will hear the petitions today at 2.30 PM.

    On Friday the Court requested the State to re-open the educational institutions at the earliest and has restrained students from wearing any sort of religious clothes in classrooms, regardless of their faith, while the matter is pending hearing.

      Kamat reads the GO - "Students should wear uniform in the interests of unity, equality and public order".

      Advocate General says the translation is not accurate.

      CJ : We also feel the translation is not accurate.

      AG : May be bonafide error.

      Kamat : If your lordship sees the GO, they say "Public Order". One of the grounds which they take is "public order".

      Chief Justice: Where is that stand? First, let the stand be made clear. Then only we can appreciate your arguments.

      Kamat : In my case, right to wear a head scarf, state cannot say that wearing it will incite passions and thus restrict practice.

      Kamat : If they say there is no public order issue, then I am safe milords. They can restrict only on grounds of public order.

      Chief Justice : You cannot assume what they will say.

      Kamat : I will be happy if the State says that. Article 25 can be restricted only on public order.

      Kamat : What is the State saying to restrict my religious right? They say public order, there will be problem for children of two religious communities.

      Chief Justice : You are assuming it.

      Kamat : Can the State take a facile plea that there will be public order issue and say this?

      Chief Justice : They have not said so.

      Kamat : That is the basis of this GO. State says there will be public order issues.

      Justice Dixit : Can you cite any judgment of Supreme Court that even remotely says that an MLA can't be part of a committee?

      Kamat : I am not saying elected representatives cannot be part of committee. I am saying public order is an essential police function, can't be left to committee.

      Justice Dixit : Are you not arguing on the validity of committee?

      Kamat : I am finished with the GO. I have tackled Article 25. Now I am on if right can be restricted saying another group is obstructing.
