    A bench comprising Justices Hemant Gupta and Sudhanshu Dhulia will hear a batch of petitions challenging the ban on wearing #Hijab in educational institutions in #Karnataka.

    A batch of 23 petitions was listed before the bench. Some of them are writ petitions filed directly before the Supreme Court seeking the right to wear hijab for Muslim girl students. Some others are special leave petitions which challenge the judgment of the Karnataka High Court dated March 15 which upheld the hijab ban. In the last hearing of the matter, the petitioners had sought request of adjournment of the matter for two weeks. However, the cout orally observed that it would not permit "forum shopping" and issued notice to the State of Karnataka and proceeded to post the matter on September 5, 2022.

    The SLPs has been filed against the judgment dated March 15 passed by the High Court of Karnataka, upholding Government Order dated 05.02.2022, which has effectively prohibited Petitioners, and other such female Muslim students from wearing the headscarf in their Pre-University Colleges. A Full Bench of the High Court comprising Chief Justice Ritu Raj Awasthi, Justice Krishna Dixit and Justice JM Khazi held that wearing of hijab by women was not an essential religious practice of Islam. The Bench further held the prescription of uniform dress code in educational institutions was not violative of the fundamental rights of the petitioners.

      Hegde : But at least in south India, there is a regression. Colleges have uniform.

      J Gupta : I had option to go to college for PUC, but I opted for college, because I wanted freedom from uniform.

      Justice Dhulia : But such power can be read into his provisions.

      Justice Gupta : In colleges, we never opted for uniform, because we wanted to freedom from uniform as worn in school.

      Justice Gupta : Are you challenging Rule 11(which talks about uniforms)?

      Hegde : It is only relating to primary education and not PUCs.

      Justice Gupta : We get your argument, that power to prescribe uniform is not given and also if you are wearing over dress, it won't be violation of uniform.

      Justice Gupta : You wear raincoats in rain to protect you from rain, not for any other purpose.

      Justice Gupta : Govt order can also insist uniform must be uniform?

      Hegde : But can the uniform be worn in accordance with my dignity. For eg, if uniform prescribes skirt, can one say ankle length is better, as per her sense of modesty or dignity.

      Hegde : The argument, when the legislature did not make any specific provision for uniform in the Act, then the rules which are made for primary education prescribes the manner in which uniform can be changed, then by a mere govt order..

      Justice Dhulia : Why are you referring to Section 39? It deals with withdrawal of recognition.

      Hegde : It says recognition can be withdrawn on grounds to religious discrimination. So the purpose of the Act is to prohibit denial of education on religious discrimination
