    A motion to impeach Justice Shekhar Kumar Yadav, Judge of the Allahabad High Court, was submitted to the Secretary General of Rajya Sabha today. The motion was signed by 55 Rajya Sabha MPs, which is beyond the limit of 50 MPs required to move an impeachment motion.

    A delegation led by Kapil Sibal submitted the impeachment motion. The delegation included MPs Vivek Tankha, Digvijaya Singh, P. Wilson, John Brittas and K.T.S. Tulsi.

    The impeachment of Justice Yadav is sought over the speech delivered by him at Prayagraj last Sunday at an event organised by the Vishwa Hindu Parishad. The impeachment motion is moved alleging that the speech of Justice Yadav was "inflammatory, prejudiced and directly targeted minority communities".

    Referring to Justice Yadav's statement that the country will be run as per the wishes of the majority, his remarks against the Muslim community and the use of the slur "Kathmulla", the impeachment motion stated that he violated the oath of office as a judge and violated the secular ethos of the Constitution. Objection was also taken to his statement that Muslim children can't be expected to exhibit kindness as they are exposed to slaughtering of animals at a young age.

    By making divisive and prejudiced statements, Justice Yadav has eroded public confidence in the judiciary, the motion alleged. The judge's statements regarding the Ram Janambhoomi movement are political in nature and affect the independence of the judiciary. "Such statements jeopardise the judiciary's role as a neutral arbitrator and protector of rights, it leads to a complete lack of faith in a litigant approaching the court with folded hands," the motion stated.

    Under Articles 124(4) and 124(5) read with Article 217(1)(B) and Article 218 of the Constitution of India, a judge may be removed from office on grounds of actions that undermine judicial ethics, impartiality, and public trust in the judiciary.

    Following several complaints filed before CJI Sanjiv Khanna, the Supreme Court sought a report from the Allahabad High Court regarding Justice Yadav's speech.
