The Supreme Court on Tuesday rejected an oral plea made by the father of the student who died by suicide in Kallakurichi in Tamil Nadu to stay the re-postmortem of the body which is to be held today as per the direction of the Madras High Court.

The father has approached the Supreme Court seeking to include a doctor of his choice in the panel constituted by the High Court for re-postmortem of the girl's body. The High Court had rejected the said prayer of the father.

Today morning, Advocate Rahul Shyam Bhandari mentioned the matter before the Chief Justice of India for urgent listing. The CJI agreed to list the matter tomorrow. Then the counsel submitted that the re-postmortem is to be held today and sought for stay of the same.

"Sorry, the High Court is already seized of the matter", the CJI said.

The counsel appearing for the State of Tamil Nadu told the CJI that the High Court has constituted the team of doctors of re-postmortem.

"You have no trust on the High Court?", the CJI asked the petitioner's counsel. Although the counsel pressed for at least an oral direction to the State to put off the re-postmortem, the CJI refused.

The High Court had rejected the petitioner's prayer for including doctors of his choice in the panel by observing that "such inclusion is sought for not any bona fide reasons, since it was projected first time during the submissions, not even in the petition".

"Though this Court having all the sympathies with the parents of the young child who died unnaturally, taking overall situation in the manner which violence erupted and executed, this Court is of the view that inclusion of the Doctor of choice of the Petitioner may not be necessary at this stage. This Court has selected the Doctors after the thorough verification and included them as the team of Doctors. The well known Expert Mr. Santhakumar is also included. In such a view of the matter the contention of Mr.Sankarasubbu cannot be countenanced", the High Court observed. The High Court also transferred the investigation of the case to the CB-CID.

Violent protests had erupted in Kallakurichi following the suicide of the girl in a boarding school.
