#BREAKING Kerala High Court holds that the Vice Chancellors of the nine Universities can continue in their positions until the Governor/Chancellor issues a final order following the show-cause notices issued to them today. All contentions of parties are left open.

    • 24 Oct 2022 12:21 PM GMT

Bench : Needless to say, till such time Chancellor issues a final order, the petitioners will be eligible to continue in their positions however in full compliance of law and regulations.

    • 24 Oct 2022 12:19 PM GMT

Bench : The argument of the petitioners that the Chancellor cannot issue a show cause notice is also left open and all the remedies of the petitioners to even impugn the same are left open.

    • 24 Oct 2022 12:18 PM GMT

Bench : Every issue, be that the competence and jurisdiction of the Chancellor, is left open.

    • 24 Oct 2022 12:18 PM GMT

Bench : I have not considered any of the contentions of the petitioners or the Chancellors with respect to the competence of the latter. The precedence cited by both sides have been looked into by me.

Bench : With Jaju Babu now saying show-cause notices have been issued, the relevance of impugned communications is lost. It obviously mean they are in service and they can continue until they are removed as per law.

    • 24 Oct 2022 12:16 PM GMT

Bench : A proper enquiry and thought has to be invested particularly when petitioners have specific cases to their factual scenarios, some of them saying judgments of the SC do not apply to them and that Chancellor does not have jurisdiction.

    • 24 Oct 2022 12:15 PM GMT

Bench : If the vitiating factors become attached to the petitioners, their appointment does not become untenable from 24.10.2022 but from abi initio and I cannot understand how the Chancellor could have watered it down.

    • 24 Oct 2022 12:15 PM GMT

Bench : 22.10.2022. It does not require much judgments to say no one can be asked to tender resignation and interestingly Jaju Babu says the communication was to save the VCs from ignominy. The Court cannot accept such an advice and for that reason the communication has to fail

    • 24 Oct 2022 12:14 PM GMT

Bench : The submission of Jaju Babu clears the air. I had reservations about the communications issued by the Chancellor because; for one, it asks the VC to tender resignation and too within the shortest period possible, and second it dictates that they have ceased to be VCs from
