Makers Of 'Udaipur Files' Movie Approach Supreme Court Against Delhi HC's Stay Order On Release

The producer of the movie 'Udaipur Files : Kanhaiya Lal Tailor Murder' has approached the Supreme Court challenging the Delhi High Court's order of July 10 which stayed its release. After the petition was mentioned today by Senior Advocate Gaurav Bhatia for urgent listing, a bench comprising Justice Surya Kant and Justice Joymalya Bagchi agreed to list the matter in a day or two.To recap, the Delhi High Court passed the impugned order a day before the scheduled release of the movie (July 11), after hearing the petitions filed by Jamiat Ulema-i-Hind President Arshad Madani (respondent) and a few other individuals who alleged that the film was communally provocative and maligned the Muslim community. The High Court asked the petitioners to approach the Central Government in revision against the CBFC certificate and stalled the movie's release till the Centre's decision on the revision.Bhatia, seeking urgent hearing, submitted that the High Court's order was passed a few hours before the film's scheduled release. He highlighted that theatres were booked and advance ticket bookings were accepted, and while all arrangements were ready for the film's release, the High Court's stay order came. He also pointed out that the Supreme Court itself had refused urgent hearing to another petition, filed by an accused in the Kanhaiya Lal murder case, against the film.In response to a specific Court query, the senior counsel told the bench that the movie was allowed to be released by the Certification Board. "Movie is allowed by certificate board, I had the certificate. All theatres were booked...I must say with some responsibility that it's a case of violation of fundamental rights.
