      Justice Saran: We have to see if bail can be granted or not. With regard to other issues, other remedies are there. In a bail matter, how far can a person go ? Liberty of a person is the first thing to be seen. Conduct of others is to be seen in relevant proceedings.

      SG: If you are treating this as a ground for bail dehors the atmosphere, then you are right. If the HC considers it at the same level, I have no difficulty. But, when there are 3000 people and there is a siege, these grounds are vitiated.

      Bench: There are two strands - one against whom chargesheet is filed and one against whom it has not been filed. On this ground the CBI court has granted bail.

      SG: This is a very serious matter. The bail was vacated without any change of circumstances. Would you not like to examine this ? We don’t press beyond a point in all matters ? This is very very serious.

      Bench: That will demoralise the HC if we transfer the matter.

      SG: I am not saying don’t trust the Hc. I am saying transfer the matter outside the State. The State is not to be trusted.

      Justice Gavai: We read from LiveLaw and Bar and Bench that it was your request to be heard by this SC. HCs are also constitutional courts. There’s no difference except hierarchy of appeal.
