Plea In SC Seeks Implementation Of Citizenship (Amendment) Act And Action Against Protestors

A petition has been filed in the Supreme Court seeking implementation of Citizenship Amendment Act, 2019 (CAA) and for action against those who caused damage to life and property, and the parties who allegedly instigated them, in light of the ongoing protests that broke out against CAA.The petitioner, who describes herself as a citizen who is concerned over the loss of lives and damage to property across the country, has also urged the top court to declare the CAA constitutional and further direct it to be implemented "aggressively" in all states.Filed through advocate Vineet Dhanda, the petition alleges that the protests, that have been on throughout the country, are politically motivated by parties who are out of power and is as a result of their vendetta against the central government. It is further alleged that wrong information has been spread by such political persons, which in turn has created a sense of terror and concern in the minds of the Muslim community. The petitioner accuses 'political persons' of conspiring against the government and creating an environment of fear and violence because of their own political agenda, which has essentially led to the loss of around 50 lives and hundreds of crores in public property. Beyond this, urges the petitioner, the country has been brought to disrepute as a result of these events and that is a "gross violation of Article 111" of the Constitution."Political persons belonging to various political parties across India started misguiding and spreading false rumors and hereby creating a sense of terror and concern in the minds of community belonging to Muslim people across the country. The political persons belonging to various political parties which are out of power hatched a conspiracy against the government.""Political persons with a vendetta against the government and its progressive approach have created an environment of hatred, fear, violence in various parts of the country for their vested political interest as a result of which around 50 precious lives have been lost in various parts of the country and public property worth hundreds of crores has been destroyed. The negative environment of fear and violence has resulted not only in the loss of precious lives, damage to public property but also has caused huge economic loss across the country and has also bought a bad name to our country."The petitioner goes on to specify that the 'false rumours and fear' were initially spread from Delhi through 'an MLA' and then alleges that other political parties provoked the students of "Jamia Millia Islamia University to create disturbance in the city of Delhi." Further naming JawaharLal Nehru University, the petitioner says that it is now fashionable for students to take an anti-India stand, which is capitalized upon by political parties and 'urban naxalites' to carry out anti-national activities."Be it abusing the Hon'ble Supreme Court Judges after Yakub Memon's hanging or hanging of Afzal Guru by part of the students of Jamia Millia Islamia University and Jawahar Lal Nehru University to full blown fight with police after Citizenship Amendment Act was passed, Anti-India stand has become fashion of many students belonging to these institutions who otherwise are famous for the achievement of their legendry students. The students belonging to these institutions are provoked into violence and Anti-India activities by various out of power political parties and urban Naxalites who are dead against the development of our country."Citing a number of articles from various organisations, the petitioner submits that she decided to approach the apex court for an efficacious remedy in light of the violence in "states like Assam, Haryana, Maharashtra, Telangana, Uttar Pradesh, Delhi and other parts of the country."In addition to her concern regarding the violence, the petitioner also raised grounds for declaring CAA constitutional and sought for its implementation across the country. It has been submitted that the Act purports to protect minorities in three countries where such minorities are subjected to brutalities by the majority, and it is the duty of our country to, therefore, save them. Given the intent of the amendment, the petitioner also submits that it would not affect the Muslim community in India in any way."It is the prime duty of our country to save these minority communities of Afghanistan, Pakistan, Bangladesh from being brutalized, killed, converted, raped by the majority community of these countries. With an aim to save the above mentioned innocent minorities, the citizenship amendment Act has been passed."In her prayer, the petitioner has asked the court to also direct the Central government to widely advertise information about CAA so as to clarify that it is not against the spirit of the Constitution or against any citizen.
