CJI: yesterday, someone pointed out Delhi HC is seized. We could have said let all matters go there. But since other states also involved [we entertained]

SG: Students have a right to protest peacefully and if anyone has violated law of land, they have to be punished. There is a set of pleas where police officers are here...there are 250 policement who have received injuries. We as state cannot do something which demoralizes police officers the de-truth has to come before court

CJI: For attacks on police officers, it is to be considered whether it is done by students or...

SG: I don't think it was by students...maybe some miscreants penetrated into the movement

CJI: Despite our best efforts, if we start going into qusetions of fact...we won't be able to...most conservative language if we use...we can say prima facie case for independent enquiry is made out

CJI: The only thing about legal principles you will appreciate - there are judgment by this court...a time has come when all these principles need to be collated and expanded. Judicial protocol means...to what extent 2018 directions are relevant in 2026? Probably, we need to have a mechanism to ensure protocol comes into effect immediately when such circumstance is there.

Sr Adv Shadan Farasat: Bihar govt has said it's withdrawing FIRs...but more than 150 minors are still in custody. They should be released forthwith. Custody of more than 48 hrs. Sent to Magistrate after 40 hrs. One boy is 13 yrs old.

Diwan: Third feature - use of electric batons. There are reports of electric shock weapons being used at protestors...a young protestor yelped in pain...electrical shields also used in national capital. Excessive force through lathi-charge and tear gas. There is a protocol, but it was breached apparently. To curtail attendance, there are reports of police intimidating with [false] cases. Then - violence against women and children. On 20 July, senior delhi police officer slapped a woman without provocation.

CJI: These require a thorough probe. No doubt. That probe should be independent, fair, transparent. What will be the compositino, we will share later.

CJI: There has to be completely independent probe. Whoever has committed excess, law will take its course. Probe is meaningless if no responsibility is fixed

Gopal S: SIT may be headed by a former judge of this court. Nothing short of that will send out a message. Despite everything, yesterday a cop in Bihar used AK47!

Sr Adv Shyam Diwan: These instances of excessive force , we have categorized them. We have given credible media reports and photos. Very serious use of pellet guns. Violence by police officials in civil dress.

CJI: We don't think elaborate arguments are required...It was completely a peaceful protest by students raising some demand. It was within constitutional framework. By their version, they want to say that in such type of peaceful protest, there are awlays uninvited guests. They will enter with agenda...very soon they become co-host...on behalf of students, it is said despite constitutional right, we were treated like this.

Gopal S; no order was there for Jantar Mantar...protocols are there for police to announce on loudspeakers that this is what we are going to do...water cannons...lathis below legs...tear gas is a later step...

CJI: Every stakeholder should come out with constructive suggestion. Earlier protocol suggested by this court, with passage of time...lot of things happening in non-conventional manner. We need to address what kind of tear gas etc. used, whether to be allowed...in a democracy, agitations are bound to be there

Hearing in #StudentProtests matter begins

Sr Adv Gopal Sankaranarayanan: This deals with the protests that have been taking place across country. Incidents in MP, Nagpur, Bihar, etc...not just Delhi. Multiple incidents...

CJI: There are some allegations in all petitions...but if you broadly see...one is use of pellet guns on account of which 19 yr old boy has suffered loss of eyesight...there are instances of use of electric batons...young woman admitted to ICU...use of lathis with nails resulting in life threatening...another instance of assaulting of a media person also. yesterday it was mentioned also. He has been mercilessly assaulted...then violence perpetrated by police in civil dress. Another case of young woman being slapped by policeman without provocation...today separate petition filed regarding excessive.

An advocate has approached the Supreme Court alleging that he was assaulted and abused by the Delhi police when he visited the Nizamuddin Police Station on July 23 for the release of students detained over their participation in the protests at Jantar Mantar over the exam paper leak issue.

The applicant is Advocate Manik Gupta, who has been practising in various Courts in Delhi, including the Supreme Court. Gupta sought intervention in the writ petition pending in the Supreme Court raising the issue of police force on protesters.

In the application, Gupta said that on the night of July 23, he visited the Nizamuddin station pursuant to the distress calls received from detained students. He alleged that the Station House Officer intimidated him and instructed the other officers to detain him as well. He was then allegedly taken to a room where a police officer pulled his neck, slapped and punched him. When he said that he was a lawyer, he was abused, and the police officer allegedly told him that he would be taught a lesson. As per the complaint, the SHO later called him and threatened to register an FIR against him. The SHO then called the lawyer's father and told him that he was roaming on the streets at night. He was released after his lawyer friends reached the station.

He has urged the Supreme Court to direct investigation into the matter, under the supervision of an independent authority or a retired judge, and also initiation of departmental action against the officers. He has also sought the preservation of the CCTV footage of the Station pertaining to the relevant time.
